Please read these terms carefully before using FoodFund. By accessing or using the FoodFund platform, website, or services, you agree to be bound by these terms. If you do not agree, do not use the platform.

Note: These terms cover use of FoodFund as a donor or visitor. Creators have additional obligations under the separate Creator Agreement, which applies in full alongside these terms. FoodFund operates as a two-entity hybrid — see Our Structure for a full explanation.

1. What FoodFund is

FoodFund is a hunger relief content network operating through a two-entity hybrid structure. FoodFund Foundation is a 501(c)(3) nonprofit that holds the charitable mission, receives all donor contributions, issues tax receipts, and disburses funds to verified food bank partners. FoodFund Inc. is a for-profit technology company that builds and operates the platform under a Technology Services Agreement with the Foundation. All donations flow through FoodFund Foundation — donations may be tax-deductible to the extent permitted by law. 2. Eligibility

You must be at least 18 years old to make a donation or create an account on FoodFund. By using the platform you represent that you are 18 or older and have the legal authority to agree to these terms. If you are using the platform on behalf of a business or organization, you represent that you have authority to bind that entity to these terms.

3. Donations

Donations made through FoodFund are processed by Stripe, Inc. as our payment processor. By submitting a donation you authorize FoodFund and Stripe to charge your payment method for the stated amount. All donations are in US dollars.

FoodFund deducts a fixed 4% platform fee from each donation before remitting the remainder to partner organizations. This fee is disclosed at checkout and shown on every receipt. The fee covers payment processing costs, platform operations, and creator revenue share. It does not come from the funds remitted to food programs.

Donations are generally non-refundable once processed. If you believe a donation was made in error, contact support@foodfund.com within 7 days for case-by-case review. Chargebacks initiated outside of this process may result in suspension of your access to the platform.

4. Fund disbursement and organization selection

FoodFund disburses collected donations to verified 501(c)(3) partner organizations on the first business day of each calendar month, covering all donations made during the calendar month two months prior. For example, donations made in January are disbursed on March 1st. This two-month cycle ensures all Stripe transactions have fully settled before reconciliation and disbursement. In the worst case, a donor’s funds reach the partner organization within approximately 60 days of the donation date.

FoodFund holds collected funds in a dedicated account during this period, separate from general operating revenue. Funds are never used for FoodFund’s own operations. A minimum disbursement threshold of $25 per organization per cycle applies, with sub-threshold amounts rolling forward. Full details are in our Donation Policy.

Donations are directed to the organization designated by the creator whose page facilitated the donation, as disclosed at checkout. If a designated organization becomes unavailable, FoodFund will redirect those funds to the nearest active partner organization in the same region and notify the affected creator within 5 business days.

5. Partner organizations

All recipient organizations are verified 501(c)(3) entities with active IRS exempt status, re-verified annually. FoodFund does not guarantee the operations, accuracy of reported impact, or continued eligibility of any partner organization. A current list of partners with EINs is available at foodfund.com/organizations. FoodFund reserves the right to add or remove partner organizations at any time. Removal of a partner organization will trigger the fallback disbursement process described in the Donation Policy.

6. Creator referral attribution

When a donor arrives at FoodFund via a creator’s referral link, that creator receives attribution for any donation made during the session. Attribution is tracked via a first-party browser cookie with a 30-day expiry. No personal information is stored in the attribution cookie. Attribution affects creator revenue share only — it does not change the amount received by partner organizations or the donor’s receipt.

7. Prohibited uses

You may not use FoodFund to:

  • Submit fraudulent, unauthorized, or stolen payment information
  • Circumvent the platform fee or attempt to redirect funds outside the platform
  • Automate donations or use bots to inflate creator metrics
  • Misrepresent your identity, affiliation, or the purpose of a donation
  • Use the platform in any way that violates applicable law

Violation of these prohibitions may result in immediate suspension, cancellation of pending donations, and referral to law enforcement where appropriate.

8. Intellectual property

The FoodFund name, logo, platform design, and all original content on this website are the property of FoodFund Inc. and may not be reproduced, redistributed, or used in any commercial context without written permission. Creator content remains the property of the respective creator. By submitting content through the platform, creators grant FoodFund a non-exclusive, royalty-free license to display that content in connection with FoodFund’s services.

9. Disclaimer of warranties

FoodFund is provided “as is” without warranties of any kind, express or implied. We do not warrant that the platform will be uninterrupted, error-free, or that any specific amount of funds will reach any particular organization. We make no representations about the tax treatment of donations made through the platform. You should consult a qualified tax advisor regarding deductibility.

10. Limitation of liability

To the fullest extent permitted by law, FoodFund Inc., its officers, directors, employees, and affiliates shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the platform, including but not limited to loss of funds due to payment processor error, organization insolvency, or platform downtime. FoodFund’s total liability for any claim arising from these terms shall not exceed the amount of the donation giving rise to the claim.

11. Indemnification

You agree to indemnify and hold harmless FoodFund Inc. and its affiliates from any claims, damages, or expenses (including reasonable attorneys’ fees) arising from your use of the platform, your violation of these terms, or your violation of any third-party rights.

12. Privacy

Your use of FoodFund is also governed by our Privacy Policy, which is incorporated into these terms by reference. By using the platform, you consent to the data practices described there.

13. Changes to these terms

FoodFund may update these terms at any time. We will post the updated terms on this page with a revised date and, for material changes, send notice to registered creators by email at least 14 days before the change takes effect. Continued use of the platform after that date constitutes acceptance of the revised terms. We recommend reviewing this page periodically.

14. Governing law and disputes

These terms are governed by the laws of the State of California without regard to conflict of law principles. Any dispute arising from these terms or your use of FoodFund that cannot be resolved informally shall be submitted to binding arbitration in San Francisco, California under the rules of the American Arbitration Association, except that either party may seek injunctive relief in any court of competent jurisdiction to prevent irreparable harm.
