FoodFund Creator Agreement

1. Who this agreement is between

This agreement is between you (“Creator”) and FoodFund Inc. (“FoodFund”). By completing the creator application and checking the acceptance boxes below, you agree to these terms in full. If you do not agree, do not submit the application.

2. You own your social media accounts

You confirm that you are the owner or authorized administrator of every social media account, channel, and profile you list on your application. FoodFund does not claim any ownership of your content, your audience, or your accounts. You are responsible for everything you post on your own platforms. FoodFund has no editorial control over your content and does not endorse specific posts.

3. How donations work

Donors give any amount from $1 through your personalized FoodFund page. FoodFund collects those donations, deducts a transparent 4% platform fee, and remits 96% directly to your chosen verified 501(c)(3) food program partner. You do not handle donor funds at any point. FoodFund Foundation is the donation facilitator of record for all transactions.

4. Your earnings

FoodFund pays creators a revenue share of 1–2% of the platform fee collected through their page, based on monthly donation volume. This share is paid from within FoodFund’s 4% fee — it does not reduce the 96% that goes to food programs. Earnings are held for 30 days after each transaction and released once your balance reaches the minimum payout threshold of $50. You may elect to re-donate your earnings to your chosen food program at any time through your dashboard.

5. Tax documentation — IRS Form W-9 and 1099

FoodFund is required by US law to issue a Form 1099-NEC to any creator who earns $600 or more in a calendar year. Before your cumulative earnings reach $600, you must submit a completed IRS Form W-9 through your creator dashboard. FoodFund will notify you by email when your earnings approach this threshold. If a valid W-9 is not on file when your balance reaches $600, your payouts will be paused until it is received. You are solely responsible for reporting and paying any federal, state, or local taxes owed on earnings from FoodFund. FoodFund does not withhold taxes on your behalf.

6. Electronic payments — ACH authorization

You agree to receive all earnings exclusively via electronic payment, either by ACH bank transfer or an approved digital payment method such as PayPal. By accepting these terms, you authorize FoodFund to initiate ACH credit entries to the bank account you provide in your payout settings. You may update your payment information at any time through your dashboard. FoodFund does not issue payments by check.

7. Your contact information

You agree to provide and maintain a valid email address and a working mobile phone number. Here is exactly why we need each one:

Email — We use your email address to send payout notifications, your annual 1099 tax document, account security alerts, and important platform updates. It is also your login credential. We do not share your email with third parties or use it for advertising.

Mobile phone — We use your mobile number only to verify your identity when initiating a payout above a certain threshold, and to reach you about time-sensitive matters such as an upcoming W-9 deadline. We will not send you marketing text messages. Standard message rates from your carrier may apply. You can update either contact detail at any time in your dashboard.

8. Code of conduct

You agree not to use your FoodFund page or creator status to promote content that is hateful, discriminatory, sexually explicit, or that misrepresents FoodFund or its partner organizations. You agree not to solicit donations outside of the FoodFund platform in a way that implies FoodFund’s endorsement. You agree not to create misleading impressions about how much of a donation reaches food programs. Violation of these conduct standards may result in immediate removal from the platform and forfeiture of any unpaid earnings.

9. Termination

Either party may end this agreement at any time. If you close your account in good standing, any earned balance above the minimum payout threshold will be paid out within 30 days. FoodFund may terminate your account immediately for conduct violations, in which case earned but unpaid amounts may be forfeited at FoodFund’s discretion.

10. Changes to these terms

FoodFund may update these terms from time to time. We will notify you by email at least 14 days before any material change takes effect. Continued use of your creator account after that date constitutes acceptance of the updated terms.

11. Governing law

This agreement is governed by the laws of the State of California, without regard to conflict of law principles. Either party may update the governing jurisdiction by mutual written agreement.
